I am 34 weeks pregnant and some.....hit me i have my unborns car seat in here already does this mean i have to buy a new one? I know once you get into an accident a car seat is no longer good but its never been used. What about my 2 year olds car seat he wasn't with me but it hit the side where his is.

  • I think it only needs replacing if it was being used during the accident, but do NOT quote me on that one. I would ask your insurance agent; I had to ask mine after my car accident last month.

  • yes and yes.
Everyone I have spoken which includes police officers have said that once in a car accident the carseat is no longer considered structurally safe and need to be replaced. The plastic can have hair line cracks that you can not see but will affect the out come of your childs safety if you were to get into another accident with them in it.
  • If you have insurance (which you should) or the other guy's insurance (depending on who was at fault) will most often times replace the car seats or reimburse replacement.

@their_mommy - I work for an insurance co in the auto claims department and in Ca there is a law that states if you were involved in a car accident you need to replace your car seat and you will be reimbursed by the insurance co. Did you save your receipt?

Gov. Gray Davis signed into law a measure that compels insurance companies to replace children's car safety seats after any accident, even if a seat shows no sign of damage. The law is the first of its kind in the nation. In part, the law was designed to raise parents' awareness about the hidden hazards of used car seats, said Sen. Liz Figueroa (D-Fremont), who wrote the measure. Just 2% of parents are aware that car seats can lose their structural integrity in minor collisions, even if they appear fine, federal safety surveys show. The new law won approval over objections from the insurance industry, which argued that automatic replacement went too far.

  • Are you and baby ok? I was in car accident 2 weeks ago and my 5 year old car seat was in there she wasn't thank god but car seat can not be used! I have to get another one but I believe the I insurance company for the other car is paying.
