big problem beed help asap

K well i live in a 2 apartment building n the landlord lives down stairs well she has roaches and now theyre up here and i cant seem to get them out. What can i do?? I need to get rid of them asap any advice?? I have a 10 month old and im pregnant almost due. I cant even sleep anymore i feel like if theyre crawling on me... im scared of ghem getting into my daughters crib.. i hate them sooo much ive been crying cuz were just soooo annoyed.....help plz!!!

  • Your landlord would be responsible for removing them! I would let them know that you need them removed as soon as possible ... roaches multiply like crazy and can can be very dangerous for little ones because they can effect your breathing good luck!
  • I would write a notarized letter and keep a copy notifying your landlord of the problem. Give them a set time frame to take care of the issue and let them know if it is not resolved by then, that you will be breaking your lease with no penalties. It will help if you include the code from your state that allows you to break a lease for issues like this (unsanitary, etc etc- every state has them). If they do not attempt to take care of the problem, a REAL attempt, leave. Keep documentation of everything. Pictures, etc. If they sue you for rent, then you have a case.
  • Most landlords have the obligation of fulfilling the landlord-tenant laws and statutes about "habitability." A landlord has to provide a habitable living environment for his or her tenants, this includes a sanitary living space. A roach-infested apartment is not considered sanitary. I would put in a request/complaint in writing and take pictures. If your request are not met, you are not obligated to pay rent until the matter is taken care of. Although, if your landlord is a slob and supports the habitat for cockroaches, then you are in for an ugly fight! Remember, if the landlord is noncompliant, you don't have to pay rent and make sure to file a formal complaint with the Department of Housing in your area. This is where you will need evidence so keep a copy of your written request and pictures.
