A 12-year-old boy has been found guilty of reckless homicide in Indiana after he shot dead his six-year-old brother in an argument about chores.

The judge ruled the boy, who cannot be identified for legal reasons, knew he should not have pulled the trigger but did not mean to kill his brother, NY Daily news reports.

The judge said the child should have known the .22 calibre weapon could kill because he had experience hunting.

The boy told the court he shot his younger brother after they had an argument about cleaning.

"I said 'clean up your room,' he said 'no'," the boy testified.

The 12-year-old put the gun back in his mother's bedroom and then called police, telling them his younger brother had shot himself.

The boy's aunt Karri Vandagrifft said the sentencing was fair given the boy was "going to have to live with this every single day".

The boy faces detention until he is 18 but could remain under probation until he is 21.

  • Guns have there place locked in the gun safe!!! I think in cases like this the parents should be charged with murder for not being responsible about gun safety!
  • Drives me crazy that the parents/parent(?) Has a gun in the house, the child had access, knowledge how the gun works, and the gun wasn't in a safe or locked!! My two year old knows better then to look at my husbands .45 let alone touch it. . . It was left in toddler reach once. Colt didn't care about the gun he was interested in the velcro on the holster. . . Didn't matter I tore a strip out of both of them. There has yet to be a repeat
  • This is EXACTLY why I have a key-entry lock on my bedroom door. No matter where my husband and I are, our guns are close by. He takes his .45 everywhere as I keep my .40 with me. But if im at home, it, along with "the bitch" (12 guage sawed off shotty) stay LOCKED in my room and only my husband and I have access to the key
  • Aw man! The boy knew what he did. He should have just complained to the parents so they can correct the minor issue. There Was no reason for this kid to shoot his baby brother. What an ASS!
  • omg that poor little boy (6yr old) and i believe if youre going to have guns in your house then you shouldnt have them at easy access pints from your children i think this boy should have been educated about the gun besides how to use it for hunting he knew the effects and outcomes if he pulled that trigger.....he shouldve been taught that the gun is only to be used for hunting and not to be used without permission....i think the parent(s) are somewhat at fault also :(
