Bout to file a lawsuit against my employer.

So I requested to have my hours changed so I can work a normal shift rather than a split shift because its taking its toll on me going to work then going home and coming back since I am so sick with all day sickness. Their response is, is that if I change my hours they will demote me and whether or not I change my hours they are still thinking about demoting me. WTF. I come to work everyday sick as a dog and have been here 4 years and they are gonna play me like this. Basically they are denying me my right to go to drs appointments since they are forcing me to be demoted. I know I'm protected under fmla to go to my drs appointments but they wanna dick me around. Last month they suspsended me for wearing my coat when I was cold like cmon people stop fishing and just leave me be.

  • Do you have an HR office? I suggest making a written formal statement to them first about how you feel your being treated. They may cave and assist you better. If not then you should go ahead and speak to a lawyer. Good luck!!
  • What is fmla? I have a feeling that I'm going to eventually have the same issue with my employer.
  • fmla is the family medical leave act. It's a federal law that requires employers with 50 or more employees to not penalize employees when they or family are sick, and also requires that women be given 12 weeks unpaid time off with the promise of the same or an equivalent position when they come back to work. Some companies require that you put in a request to use it.
  • My employer fired me because my doctor requested me go on light duty (i was a cna)...i had my boss put in writing why she was firing me and it said "therers no position for me in my situation" I was furious so I went to the equal employment opportunity program office in my city and filed a complaint....it was bad!
  • When my employer found out I was pregnant, they gave me a choice to cut my hours or they would fire me. They let me keep working, I had to train my replacement, then they fired me anyway. They gave the other girl my promotion while I was still working there, and they made the paperwork look like I resigned and could still go back to work for them, after she was born, they wouldn't accept my application.

  • Wow my boss says that they are going to pull all pregnant ladies off their assignments until we have a been released by the doctors because this one lady had an mc on the job. I spoke with this attorney in my building he said that can happen if your baby is in danger. I do security and sit at an freaking desk for 7 hours. That's discriminating.
  • I work in health insurance and have no issues performing my job duties. I sit at a desk nothing strenous. I just need some time for drs appointments. I am working 8 to 1230 then go back from 430 which is a lot on me rather than working 8 straight hours. Plus its killing my gas and I can't put my kids to bed or eat dinner with them. They are pushing me to far. And its funny how all this comes about after I submit my paperwork for fmla well in advance of my due date so they can't say I didn't give them enough notice.
  • Idk what's going on this yr with these employers smh... This is my second pregnancy with my job n now all of sudden they say they can't save my position at that location meaning when I come back if there's no spots I would have to b a float which I def do not want... y would they want to get rid of u when I u need a job the most... how r we supposed to feed our kids or keep a roof over our heads??? I don't get it n if I do end up with no job oh they will b getting sued bcuz I'm a good worker n never been written up
