Eviction? (npr) UPDATE AT TOP!

Can you be evicted without a court ordered notice? Do they have to give you a certain amount of time to be out?

Forgot to add...its not my landlord trying to evict me. Its the lady how owns the lot. If that makes any sense.

OK SO WE AGREED TO GET RID OF OUR DOGS..JUST FED UP WITH THE DRAMA! MY RENT LADY COMES TODAY TO FIX THE PIECE OF UNDERPENDING. WHILE IM TALKING TO HER ABOUT US GETTING RID OF THE DOGS..THE LOT OWNER CALLS HER. SHE TELLS HER THAT WE ARE GETTING RID OF THE DOGS. THIS BITCH(EXCUSE MY LANGUAGE) SAYS SHE DOESNT CARE..SHE STILL WANTS US OUT! MY RENT LADY TRIES TO EXPLAIN TO HER THAR I JUST HAD A BABY & ITS VERY CLOSE TO CHRISTMAS. THE LADY IS STILL INSISTING THAT WE BE PUT OUT! WTF! THIS WOMAN IS SOO STUPID! ANYWAY..MY RENT LADY SAYS THERE IS SOMEONE OVER THIS LOT OWNER..SHES JUST LIKE THE SUPERVISOR OR SOMETHING..SO SHES GOING TO TALK TO THE HEAD LADY & SEE IF SHE CAN MAYBE GET US TO BE ABLE TO STAY. WE DO NOT HAVE MONEY TO JUST UP & MOVE WITHOUT ANY KIND OF NOTICE! I DONT HAVE MONEY FOR A LAWYER BUT IS THERE ANYONE I COULD TALK TO & FIGURE OUT MY RIGHTS? IM NOT GOING OUT WITHOUT A FIGHT. I NEED TO KNOW IF SHE CAN REALLY JUST DO THIS.

  • Here in tx they have to take you to court before you actually have to get out
  • What state are you in? I think they have to take you to court and then have the sheriff actually post eviction papers. I can give u more information if I know the state

  • They have to have the proper paperwork before they can call in the cops to start moving your belongings as long as you are on the lease.

  • Well why is she doing that?! Wouldnt she have to go through the landlord. Unless she has paperwork to prove it and a good readon then she shouldnt be allowed but thats just my opinion
  • here as well they have to give you the usual 72, 48, hour notices but thats for nonpayment and then the last being a 30 day notice from the court

    @kayleigh27 there was a stray dog running around our neighborhood. He hasn't messing with anyone but he has been getting under her house. He also tore one piece of underpending from my mobile home and we were instructed that we hd to fix it 2 weeks ago. We don't have money growing on tress to fix it & it wasn't even our dog! She said our lot looks "disgusting" because of that one piece of underpending missing. (Mind you....out of the 10 mobile homes...over half of them have at least one piece of underpending missing). Her issue really is the fact that we have a dog. But we aren't the only ones in the neighborhood with dogs. She won't admit that's her real issue because we were told that we could have dogs. Anyway she calls today threatning to have us evicted because of that piece of underpending supposedly making her mobile home park look disgusting and because of the stray dog running around. She said its our fault there is a stray dog running around. She said its because we have dogs that the stray dog is coming around. She said our dogs attracts other dogs. & she threatned to evict us. My landlord says the lady is a biatch and is always very hard to deal with. She says she has made numerous ppl move because of her antics.

  • @jules I dont think she can just make me up & leave especially without a court order first. & with a court order then I would get a court date to settle the matter. Im going around to take pictures to take pictures of the other homes with underpending missing. So if she tried to say the reason was because of that then I will have pics of the others.
  • I have been evicted from a mobile home park and it will literally take 6 months. To get a court date she has to prove reason for eviction and has she given you a written letter telling you to fix your home and from there she will need a lot more of a paper trail then just phone calls. Everything has to be in writting make sure u write down all of her phone calls time date and what was said for if u go to court u might be able to get her for harassment hopefully u have something saying u could have a dog makes her look even more like a jack ass. Remember she is being a bully and well if u have the ground and patience stand up to the bitch and show her she is not god!!

    @mylittleman2011 we dont have anything saying we could have a dog. But other ppl in the mobile home park have dogs tho & she owns all the lots. & this is the first time she has called me herself but she was being really rude. She came close to getting cursed out but I didnt want to get my landlord into any trouble. & I will stand up to her because we are not moving our for no real reason. She can kiss it & take me to court.
  • Oh yeah nc requires that she document the issue in writing and give you notice to fix it and also how it violates your lease then if you don't fix it in that time frame she can file for an eviction which you have to be properly served. Then you will get a court date and can present your side and then they will give u 30 days to leave. Chances are she is just blowing hot air because as long as ur paying ur rent evivting someone is a pain in the ass.
  • Here in Ohio it takes almost 90 days or the paper work and eviction process to happen. I havent been through it but be had to have it done for someone..... they don't have to have a reason but in most states you do and judge normally wants a reason. If you can't provide the Court with a reason they sometimes throw it out here. Another thing start taking pictures of the places around you for yourself just to prove yourself; cover your butt! She can't just kick you out and if she does you should contact an attorney!!!!!

    @momofSOONtobe7 yea im taking pictures tomorrow. & whats crazy is she is saying we are making her mobile home park look "nasty & disgusting" because of ONE missing piece on underpending. I found out 2day which mobile home she lives in(its in the same park) & her WHOLE back side of her mobile home is missing underpending except two pieces!
  • I dont think that in any state they could evict you just by themselves. Here in colorado it is 30 days, but they dont have to take you to court here. Its just that they cant notify you for it to be legal. Here the sherriff has to come to the door otherwise its illegal. Also if you take pictures of other houses without underpending and if anyone else has dogs (make sure you explain the situation and ask for their permission otherwise the evidence may not be legal to bring up).
  • Also, make sure that the others with dogs didnt sign a form for her to keep them there because if they all did, then technically you may have to get rid of your dogs to stay there.
  • @newmommyFeb2012 I know no one else signed anything saying they coild have dogs because my mother in law lives out here too & she has them. Shes lived here for years. Her only rule about them is we must have shot records & I have shown her those.
  • Well, she shouldnt be able to evict you then, but just remember its up to the court if she decides to take you to court. Good luck sweety :).

  • @kayleigh27 shes a retard! Shes suppose to let my rent lady know tomorrow what her decision is on whether my rent lady has to evict us or not. So tomorrow I will know if I need to be getting a lawyer or not! Im not leaving just because she says so!

  • @2BeForgotten my rent lady came & fixed it 2day. The dumb ass lady still wants my rent lady to put us out! She complains about every damn thing! She even told my rent lady that she doesnt like the way we park our car! Wtf is her problem!? When we do decide to move..we are going out with a bang! Lol

  • Legal aid, call your local bar associate and see if they can direct you to an attorney, call around and ask different attorneys if they need there probono case yet. There are attorneys out there that do free consultations and or don't ask for money up front but yet if you will they will take there share out of that. If you don't win they don't.
  • @2BeForgotten this is the only mobile home here that she doesnt own. Shes just pissed that she isnt the one making money on this home. & oh yea..im planning that big bang now! Lol. I should drive straight thru her front yard all over her flowers...at like 2am...blowing the horn the whole time! Oh yea..with my windows rolled down & my dog in the back seat so she can bark like crazy at my car horn! Lmao!
